This property is offered at “Public Auction” with
“No Contingencies.” Buyer
agrees to fulfill their obligation to settle for the entire purchase price
as declared by Auctioneer, or shall forfeit
all deposit monies. This property is offered in “As Is” Condition.
Any extension to the listed closing date shall be only by
Seller’s Approval.
Auctioneer or Seller makes no guarantee in regards to
potential use or occupancy purposes.

Property has not been surveyed for
this auction. If the purchaser
so desires a survey, it will be solely at the purchaser’s option and
expense. All acreage and any
dimensions are believed to be accurate.
Although, if any errors or omissions are found by a subsequent
survey or data collected, it shall not affect the purchase or purchase
price of this property. All
property is sold subject to any or all existing rights of way or
easements. Seller shall
guarantee a good and clear title to the purchaser at the date of closing
or shall be required to return any or all deposit monies and this sale
shall be void.

Auctioneer is acting on the behalf of Seller during this
Auction. The Auctioneer
reserves the right to accept or reject any or all bids.
Seller may withdraw this property from the auction at any time
prior to or during the auction. Any
or all announcements made day of sale by Auctioneer shall take precedence
over any or all previous information.

It is also understood that the Purchaser is not represented
by the Auctioneer in this or any other transaction. Buyers
agree that there are no other Agents/ Broker Agents Involved in this sale.

After declared by Auctioneer as being the highest successful
bidder, Buyer agrees to deliver a non-refundable deposit to Auctioneer and
Sellers’ Closing Agent to be deposited in the Closing Agent’s trust
account. NOTE:
This deposit can be applied to the Buyer’s settlement costs at
the agreed closing date or will be transferred to Sellers upon Buyer’s
failure to close on the agreed closing date.
